Scott F. Sullan has extensive experience litigating construction defect, construction materials, multi-family community, personal injury, class action, and insurance lawsuits. Mr. Sullan was the lead trial lawyer in nine class action lawsuits, including trial of the Mission Viejo class action involving over 900 Highlands Ranch homeowners, settlements of the Oldach/Outlook Windows case involving over 30,000 Colorado homeowners, and the Richmond Homes class action involving over 25,000 Colorado homeowners. Mr. Sullan was the driving force behind Colorado’s slab-on-grade flooring system class actions involving Richmond Homes, Mission Viejo, Falcon Homes, Village Homes, Merit Homes, and Centex Homes. Mr. Sullan tried the Mission Viejo case to a liability verdict, one of the very few Colorado class action lawsuits to be tried on its merits to a jury. Mr. Sullan has handled hundreds of construction defect cases, including successfully pursuing and settling three of the largest, multi-family construction defect cases in Colorado for $39.5 million, $25 million, and $18 million dollars in 2005 and 2007. He also settled the Oldach/Outlook Windows case for $32.5 million in 2006. Mr. Sullan is the senior member and shareholder of the Denver law firm Sullan2, Sandgrund, Smith & Perczak, P.C. (formerly Vanatta, Sullan, Sandgrund, Sullan & Smith, P.C.). Mr. Sullan and coauthor, Ron Sandgrund, have worked together since 1980.
Mr. Sullan frequently lectures on construction defect liability issues and regularly coauthors articles on the subject with his partner, Mr. Sandgrund. He co-authored Residential Construction Defect Litigation (A View From the Trenches) (Seattle: 2000) with Mr. Sandgrund, as well as the “Residential Construction” chapter in The Practitioner’s Guide to Colorado Construction Law (Robert Benson, editor) published by CLE in Colorado, Inc. Mr. Sullan has worked extensively with the Colorado Legislature and testifies frequently regarding proposed laws affecting Colorado homeowners. He was instrumental in helping write portions of Colorado’s Construction Defect Action Reform Act and Homeowner Protection Act. Mr. Sullan
has offered opinions as an expert witness regarding the reasonableness of class counsel attorney fees and costs in the Colorado District Court.
Mr. Sullan was born in Chicago in May 1953 and obtained a B.A. in psychology from the University of Colorado at Boulder, graduating cum laude. In 1979, Mr. Sullan graduated from the University of Southern Illinois College of Law and moved to Colorado. Before attending law school, Mr. Sullan worked at numerous jobs in the construction industry, including working as a laborer and as a carpenter’s apprentice on large cast-in-place concrete structures.
