“UPDATE ON ESA REGULATIONS AND POLICY AFFECTING OIL AND GAS EXPLORATION AND DEVELOPMENT”
In 2013, the U.S. Fish and Wildlife Service pursued numerous rulemakings under the Endangered Species Act that may affect oil and gas operations. The Service revised its regulations related to the designation of critical habitat and proposed to revise its regulations related to Section 7 consultations and incidental take statements. Additionally, the FWS exercised its authority to issue special rules for threatened species under section 4(d) of ESA in a proposed rule related to the lesser prairie-chicken. These efforts precede an anticipated rulemaking to revise the definition of “adverse modification” of critical habitat. In the meantime, the FWS continues to reach decisions to list or not list candidate species pursuant to its 2011 settlement. This presentation will review the Service's recent rulemaking and listing efforts and describe the implications of these efforts on oil and gas operations.

The cost of the luncheon is $30.00 for section members (seniors over 62, $27.00, and students and law clerks, $10) and $35.00 for non-members. The first 5 students who RSVP and show up in person, will be admitted free of charge, as guests of the Section.
