Citizen Initiatives, Oil and Gas Development and You
In late February 2014, two state citizen initiatives were introduced in Colorado that, if passed, will have a significant effect on natural resources. The first would permit local governments (county, city, or town) to control oil and gas development. The second would apply the public trust doctrine to ground and surface water and natural resources. These statewide citizen initiatives are in addition to local citizen initiatives passed last year approving moratoriums on and banning the use of hydraulic fracturing. This presentation will provide an update on local and statewide citizen initiatives in Colorado affecting natural resources, associated litigation, and similar initiatives in other states.
