"Pirates, Trolls, and Pornography: A Look at the Substance, Procedure, and Ethics of Mass BitTorrent Protocol Lawsuits"
Imagine one day receiving a letter or answering a harassing telephone call accusing you of illegally downloading cinematic masterpieces such as “Mina’s Fantasy” online, and threatening to sue you for this offense in open court, that is, unless you pay a few thousand dollars. In the last two years, hundreds of thousands of Defendants have found themselves in this position, as the Adult Entertainment Industry has aggressively adopted a litigation-centric “business model” based on weak allegations of copyright infringement and the inducement of fear, which is often described as a mass shakedown campaign. These lawsuits have been rampant throughout the United States, and Colorado is increasingly becoming a fertile battleground. This lunch program will discuss the present landscape of mass BitTorrent Protocol lawsuits—both nationally and in Colorado—while addressing procedural, substantive and ethical issues implicated in such cases.
Speaker: Christina Saunders, Attorney at Law, Nouveau Law LLC
Christina Saunders is the founder and managing attorney at Nouveau Law LLC. Her practice emphasizes intellectual property, business and corporate law, and art and entertainment law. Christina advises clients on both copyright and trademark issues including obtaining, transferring, licensing and commercializing intellectual property assets, and she has significant defense experience in mass BitTorrent protocol lawsuits. In addition, Christina is an active member of Colorado Business Committee for the Arts, serves as committee member for the Women’s Foundation of Colorado, and volunteers at the Denver Art Museum, and for Colorado Lawyers for the Arts. She has also served as a contributing member and volunteer for Utah Lawyers for the Arts, and founded Utah Lawyers for the Art’s Park City Chapter. Christina was selected by the ColoradoBiz Magazine as one of the top young professionals in Colorado, and was nominated for Denver Business Journal’s 2012 Outstanding Women in Business Award.
