“Avoiding the sting of Yellow Jacket Water Conservancy District v. Livingston:  Lessons for Public Entities filing Diligence Applications”
The Colorado Supreme Court recently reversed the dismissal of Yellow Jacket's timely-filed diligence applications, which were dismissed because a number of Yellow Jacket's directors were holding over past the expiration of their terms.  The Supreme Court relied on a holdover provision in the Water Conservancy Act to determine that Yellow Jacket had a quorum at the time the diligence applications were filed, and therefore had the authority to file.
However, the Supreme Court did not address whether Yellow Jacket's timely filing of the diligence applications alone was sufficient to vest jurisdiction over the applications, despite the Court's previous holdings to that effect involving private entities.
This program will explore whether a public entity must comply with additional requirements when filing a diligence application, what those requirements may be, and how to avoid a potential dismissal even if an application is timely filed.
