Program Description

The 2008 Fall Estate Planning Update program builds on the excellent programs of years past. This year's program continues that tradition of excellence with practical, up-to-date topics and expert faculty!

As always, you receive a succinct, helpful summary of the new case law and legislation that affects your trust and estate law practice.

In addition, this year's program provides you with valuable instruction in marital deduction issues, irrevocable life insurance trusts, and estate and gift tax issues. Marital Deduction Planning – Beyond the Basics

Effective use of the marital deduction is an integral part of estate tax planning for married couples. It is essential that the T&E lawyer understand the different tools available in planning for the efficient use of the marital deduction. This is even more important since the estate tax laws are in a time of great uncertainty. Topics to be considered include the following:

*When should the marital share go outright and when in trust?

*Disclaimer planning and the marital deduction

*Choosing between General Power of Appointment Trusts and QTIPs

*Choosing and drafting formula provisions for the marital deduction (fractional or pecuniary? to the marital trust or the bypass trust?)

*Working with QTIPs: partial elections, dividing QTIPs, GST elections (and the Reverse QTIP), Clayton QTIPs

*Planning for an uncertain tax future
