October 10, 2001
Present at the meeting were Dan McCune, Mike Hutchinson, Mike McConnell, Joyce Jenkins, Reba Nance, and Julie Revers.
The Committee approved the Minutes of the September 19, 2001 meeting as prepared except for correcting one typographical error changing the word “carious” to “various.”
The Committee discussed the Whoops publication. Reba Nance informed the Committee the Bar Association will be switching printing companies for the January issue. Reba also announced that there has been some delays in publishing the current edition of Whoops but she hoped to have it in the mail to members by the week of October 14th.
The Committee discussed the next substantive article for the January Whoops. Cindy Fleischner will be writing the next article.
The Committee discussed who would be assuming the editing responsibilities for Whoops Magazine. Joyce Jenkins offered to continue editing the publication and all Committee members
were in agreement.
The Committee discussed the upcoming annual malpractice prevention seminar. Julie Revers announced that they were considering changing the format for the seminar, reducing the seminar to a half day and expanding the number of locations to approximately eight to ten locations. Julie announced that they hoped to have the plans for the seminar in place by November 8, 2001 with a target date of January 24, 2002 to begin the presentations.
Robin Beatty was unable to make the Committee meeting so the Committee tabled the discussion concerning the status of the Practice Checklist until the next monthly meeting.
The Committee discussed the Lawyer to Lawyer Mentoring program proposal. The Committee formulated a plan for exploring the viability of that proposal. There was a lot of discussion about the possible liability of mentors who participate in that program and whether members would be willing to participate as mentors without some liability protection. The Committee also discussed their concern about how to implement such a program. Reba Nance reported that Wisconsin already had such a program in place. Reba is going to contact a representative in Wisconsin to address the Committee’s concerns. She will then try to make arrangements to have that representative from Wisconsin participate in a telephone conference at the next committee meeting to answer the Committee’s questions. The Committee decided that if the program looks viable, the next step would be to informally approach one or more of the Justices with the Colorado Supreme Court to explore their likely response to such a program and, in particular, the possibility of obtaining immunity for the mentors who participate in that program.
The Committee discussed whether to hold the Hanging Your Shingle program again in 2002. The Committee agreed that it would be beneficial to the members to hold that program again. Dave Little graciously agreed to chair the program.
The Committee is next scheduled to meet on November 14, 2001.
