AGENDA FOR AUGUST MEETING

 

1. Continue work on proposed language for Rule 18.2, dealing with foreign conservatorships, and corresponding forms, and change to C.R.S. 15-14-433.

1. The meeting of the Rules and Forms Committee began at approximately 12:00 p.m. on August 19, 2004.

 

2. The minutes of the May 20, 2004 meeting were approved without objection.

 

3. The committee discussed the need for a new rule and related forms to clarify the procedure for qualification of foreign conservators, to parallel the new Proposed Rule 18.1 FOREIGN PERSONAL REPRESENTATIVES, and related Proposed Form CPC 60, FOREIGN PERSONAL REPRESENTATIVE’S SWORN STATEMENT, and Proposed Form CPC 61, CERTIFICATE OF ANCILLARY FILING.

 

4. The committee discussed a draft of a rule (unnumbered, but presumably Rule 18.2 FOREIGN CONSERVATORS) and the relevant statute, C.R.S. 15-14-433. Suggestions were made to change the drafts of the rule and the statute. Copies of both, with the committee's approved changes, are attached.

5. The proposal to change C.R.S. 15-14-433 would need to be approved by Council after review and approval by the Statutory Revisions Committee. The change would clarify that it is not just the "copies of letters of appointment" that need to be filed. C.R.S. 15-13-204 Proof of Authority, for foreign personal representatives, uses the language "copies of his appointment", instead of "letters of appointment". The former language was thought by the committee to authorize the new proposed Rule 18.1 and the two proposed forms. Changing the statute would more clearly allow a rule, and related forms, to be created to require the filing of orders, letters and other documents related to the appointment.

 

6. The meeting adjourned at 1:15 p.m.
