LARIMER COUNTY BAR ASSOCIATION
EXECUTIVE COMMITTEE MEETING
Date: January 10, 2006
Location: Bluebird Cafe

ATTENDING:

Jeanne Drake, Bruce Fickel, Dick Gast, David Johnson, Kathryn Lonowski, Ian McCargar, Dan Muffly, Jennifer Rice, Randy Starr, Cathy Vlasak and Josh Zugish.

CALL TO ORDER: President Jeanne Drake called the meeting to order at 7:05 a.m.

BOARD OF GOVERNORS:

Randy also reported on the status of local appointments to fill the three seats on the Board of Governors allocated to the LCBA:

1. Zach Wilson's two year term is ending in March 2006. Mason Mitchell has volunteered to serve for the next two year term running to March 2008. Mason will be nominated and the membership will vote on his appointment at the upcoming Term Day.

2. Bruce Fickel's term ends in March 2007.

3. Randy Stan's term ends in March 2006. Randy has volunteered to serve another two year term.

YOUNG LAWYERS: Josh Zugish reported that Judge Matsch will be the featured speaker at the Law Day luncheon to be held at the Lincoln Center on May 5, 2006.

Josh also presented a request to fund prizes for the Law Day essay contest. The Young Lawyers Section requested a total of $1,000 ($500 for first prize, $300 for second prize and $200 for third prize). It was moved and seconded to provide $1,000 in funding for the Law Day essay contest prizes. The motion passed.

PRO BONO PROGRAM: Jennifer Rice reported for Becky Brelsford that:

  • Jessica Virgil-Retana will be resuming her position as paralegal/program coordinator in mid-February following her maternity leave.
  • There are some problems with program clients showing up for intake sessions without the necessary financial information to verify their eligibility. Proof of income/financial circumstances will be required before a client can be considered eligible for the program.

SPRING TERM DAY:

Jeanne Drake will check with Joe Coyte or Diane Peterson about organizing the Term Day bowling event. Ian McCarger (yes, the same Ian McCarger with the collection of bowling trophies in his closet) also volunteered to help with the bowling event.

CONTINUING LEGAL EDUCATION: Kathryn Lonowski reported on the following CLE events:

  • The LCBA-sponsored conservation easement seminar in November 2005 was wildly successful.
  • On March 24, 2006, the LCBA will be sponsoring a free family law seminar at the Lincoln Center from 1:00 - 5:00 p.m. (four CLE credits) The speakers include Magistrate Schapanski, Magistrate Hartmann, Ian McCarger, Robert Smith, John Haggerty, and also possibly Magistrate Jostad. A cash bar and hors d'oeuvres will follow the seminar. The LCBA will be footing the bill for room rental and food costs.
  • The LCBA will also be sponsoring a CLE program on May 12, 2006 entitled "Caught in the Vortex: Balancing First and Sixth Amendment Rights". This program will be held in either the Columbine Room or the Canyon West Room at the Lincoln Center. A fee will be charged to attendees. The program agenda is attached to these Minutes.

MOCK TRIAL: Ian McCarger advised that Larimer County and Weld County have put together a joint committee to coordinate the upcoming regional mock trial program. It is expected that the program location will alternate between Larimer County and Weld County in the coming years. The LCBA has agreed to pay $300 for the high school mock trial team entry fees. Ian indicated that additional funding is needed to cover the cost of food and drinks for participants and volunteers. Ian requested $650 for this purpose. On motion made and seconded, the Executive Committee approved providing $650 for mock trial food and drink expenses.

SCHOLARSHIP FUND:

Randy Starr reported that he would be getting the word out to area high schools regarding the availability of LCBA scholarship funds.
Dan Muffly will reserve the jury room for the Spring Term Day business meeting on March 7, 2006. Dan also agreed to handle the coffee and doughnuts for the pre-meeting festivities. The Term Day luncheon will be held at the Lincoln Center after the business meeting. Jeanne Drake will contact a caterer to arrange the lunch fare. The Professionalism Award will be given at the lunch, and a representative of the Colorado Judicial Institute will be on hand to honor Magistrate Schapanski as the recent recipient of the Judicial Excellence Award.
Dan Muffly is waiting for contact back from the Weld County Bar Association representative to set up a meeting with LCBA representatives.
Ian McCargar reported that Library Committee members will be undertaking phase one of the rearranging project on February 18, 2006 to consolidate all Colorado reference materials in one place. Future phases will follow depending on the availability of libations to fuel the volunteers.
Randy Starr reported that the CBA Board of Governors met on December 12, 2005 at the Broadmoor in Colorado Springs. The Elder Law section now has a seat on the Board of Governors. Diane Peterson from Loveland has been appointed as our district representative to the CBA Executive Council. In the wake of Referenda C and D, the Board of Governors discussed the use of CBA money for political causes. Randy suggested forming a CBA-sponsored political action committee to address political issues. A CBA committee has been formed to study that suggestion.
David Johnson updated the Committee members on the financial status of the LCBA by distributing the Association's Financial Statements dated November 30, 2005 along with a summary of the Association's current bank account balances (copies of which are attached to these Minutes).
The minutes of the November 8, 2005 Executive Committee meeting were approved.
