Summary: Mr. Stevens introduced the ITC as an institution and provided an overview of the substantive and procedural aspects of Section 337 litigation. This included a comparison of ITC litigation with District Court litigation, and a discussion of the pros and cons of Section 337 for enforcement of a patent. Mr. Stevens also discussed the unique remedial jurisdiction of the ITC, unique substantive aspects of the ITC's application of patent law, trends in Section 337 practice, and prospects of expanded ITC jurisdiction based on recent Federal Circuit decisions.
