MARCH 6 MEETING AND CURRENT ACTIVITIES
PROPOSED STANDARDS OF CONDUCT FOR MEDIATORS IN COLORADO
The ADR Professionals Qualifications project, which is looking at the need for qualifications for the various ADR professionals, requests your endorsement of the attached draft of Standards of Conduct for Mediators. Please see the attached letter and standards of conduct. If you have questions, please call the Chair of the steering committee, Sally Ortner-778-8005.
NEXT LUNCHEON MEETING TO DISCUSS ADR IN EMPLOYMENT
Our next luncheon meeting will address the topic of ADR in employment disputes. The panel will consist of Katie Miller, advocate for employees and neutral, Preston Oade, advocate for employers, Breck Grover, Regional VP of the American Arbitration Association, and Frtiz Ihrig, arbitrator and mediator for employment and labor disputes. Van Elmore, arbitrator and mediator and past chair of the employment study group will moderate. The manual for the use of ADR in employment disputes, which was produced by our employment industry focus group, will be handed out. Mark your calendars for June 2nd at noon at the Bar offices, 1900 Grant, 3rd Floor, Denver.
ADHOC ADR/TRANSACTIONAL LAW COMMITTEE MEETS
This committee meets on the first Wednesday of each month at 10:30 to noon in the CBA offices. It is considering a joint luncheon with our committee in October. This committee is also considering placing ADR contract clauses for specific industries on the CBA web page. If you have specific industry related ADR clauses please fax them (no longer than 5 pages please) to Ms. Sally Ortner at 778-7416.
NEXT BUSINESS MEETING - APRIL 3RD
The next CBA ADR Forum Committee business meeting will be held on April 3rd at noon in the CBA offices. Please mark your calendars.
The business meetings for the next several months are as follows: April 3rd, May 8th and June 5th. All of these meetings will be at noon at the CBA offices. The May meeting has been rescheduled for the 8th because of the ABA ADR meeting on May 1st.
MARCH 6TH BUSINESS MEETING DISCUSSES SPEAKERS BUREAU
Sally Ortner, Van Elmore, Merrill Shields, Susan Demidovich, Steve Mains, Cindy Savage, Ron Shear, Elizabeth Carver and Sheila Somberg attended the March 6th business meeting. The group discussed the speaker's bureau. Our committee has a speakers bureau to provide presentations on ADR to various interested audiences. If anyone is interested in participating as a speaker, please complete the attached form and deliver it as indicated. (Even if you have previously been involved in the speakers bureau, please resubmit a new form.) In addition, each speaker will need to complete a speaker's orientation. (Attendance at the orientation will be required despite previous attendance at past orientations.) The orientations will be held from 8:30 to 10:30 a.m. at the CBA offices on each of the following days: March 27th, April 4th and May 22nd. Please make arrangements to attend one of these orientations by contacting Diane Hartman of the CBA at 860-1115.
Please note that all sub-committee chairs are requested to attend the Business Meetings in order to provide a report of activities. If the chairs can not attend, then another member of the subcommittee should attend the Business Meeting to make an in person report. In the event that no one can attend, then a written report should be submitted to our Chair, Sally Ortner, prior to the Business Meeting. Thanks.
LONG RANGE PLANNING MEETING - APRIL 3RD
There will be a long range planning meeting for our committee at 10:30 on April 3rd at the CBA offices. This will precede the business meeting. If you have ideas or input on the direction of our committee for the future, please plan to attend. All sub-committee chairs are requested to attend.
SUB-COMMITTEES REPORT KEY ACTIVITIES
Please contact Lili Lehrburger 837-1001 for details regarding future articles. Submissions for the next of our 4 annual articles will be due on April 1ST. Submissions for future issues are also welcome. We need more articles, particularly regarding ADR in select substantive areas.
This subcommittee previously met for 2 years and produced a white paper on mediation for managed care panels and doctor termination. The rejuvenated committee now has 13 members, including nine industry people. At its second meeting, it tried to focus on subjects for activity. The subcommittee decided to avoid large public policy issues, such as bio ethics, but did decided that patient disputes regarding contract coverage and the quality of care could be good subjects.
The Education Subcommittee is handling the speaker's bureau and is coordinating our next luncheon meeting on June 2nd.
COLORADO PLEDGE SUB-COMMITTEE
The Colorado Pledge subcommittee is considering asking CFO's, CEOs, in house counsels and HR executives to attend a presentation on the general pros and cons of ADR. The subcommittee is considering handing out the neutrals directory at that meeting. In addition, the subcommittee intends to invite pledge members to our June 2nd luncheon meeting regarding ADR in employment.
ADR IN GOVERNMENT SUB-COMMITTEE
This Sub-Committee meets on the last Friday of the month. The next meeting will be on March 27th from 10 to noon at the Colorado Attorney General's office. (See contact info below for contacts.) The group is planning to draft ADR phamplets for various state agencies to use. The Attorney General's Office is planning to educate the various agencies regarding their authority to use ADR. The sub-committee is also talking with administrative judges concerning ADR use. In addition, it is looking at other states and the federal government to see what role ADR has in governments.
This sub-committee is reviewing ADR clauses for use in standard real estate contracts including a "check the box" clause for arbitration.
The employment group is evaluating bids for printing the manual and is considering various mechanisms to educate employers, employees and attorneys regarding the use of ADR in employment disputes. The employment group will be represented on the panel for our next luncheon meeting on June 2nd.
