eLegislative Report Highlight

The CBA Legislative Policy Committee voted to take action on several bills at its weekly meeting on Friday, Feb. 8. Among them are HB 13–1035, concerning an increase in the number of judges in certain judicial districts; HB 13–1038, concerning the voting rights of individuals in the custody of the division of youth corrections within the department of human services; and the Judicial Branch budget priorities. Eighth Judicial District Announces Larimer County Court Vacancy
Deadline to Apply is Friday March 15

The Eighth Judicial District Nominating Commission will meet Wednesday, April 10 to interview and select nominees for appointment by Gov. John Hickenlooper to the office of county judge for Larimer County. The vacancy will be created by the resignation of the Hon. Ronald L. Schultz on Tuesday, April 30. An electronic copy of the application in PDF format must be filed with the ex officio chair no later than 4 p.m. on Friday, March 15. Click here for more information and applications.

Colorado Supreme Court to Recognize Firm or In-house Counsel Group’s Pro Bono Achievements—Deadline Feb. 15

Each year, the Colorado Supreme Court recognizes those law firms, solo practitioners, and in-house counsel groups that achieved the annual goal of 50 hours of pro bono legal services by their Colorado-licensed attorneys—averaged across the firm and pro-rated for part-time attorneys—primarily for the indigent and/or organizations serving the indigent. Expect More FMLA Requests for Leave to Care for an Adult Child as a Result of New DOL Guidance

Employers may face additional requests by employees seeking leave under the Family and Medical Leave Act (FMLA) to care for an adult child who is unable to care for him or herself. The Department of Labor recently issued an Administrator’s Interpretation clarifying the definition of “son or daughter” under the FMLA as it relates to covered leave for an adult child with a serious health condition. Colorado Supreme Court: Juvenile Justice System is Separate Statutory Framework from Adult Criminal Justice System and Provisions Are Not Interchangeable

In this original proceeding, the Supreme Court considered whether an indigent alleged juvenile offender was entitled to a second competency evaluation at state expense. Two days after W.P.’s arrest on allegations of sexual assault on a child, and one day after the juvenile division of the Adams County District Court appointed a public defender to represent W.P., the court ordered W.P. to undergo a competency evaluation at state expense. After receiving the evaluation report, the court made a preliminary finding that W.P. was competent to proceed in the case. Click here to read more.

Check out the American Bar Association’s Legal Technology Resource Center’s (LTRC) search engine for law review and law journals.

A no-cost service, this search engine finds the full-text of more than 400 online law reviews and law journals, as well as document repositories hosting academic papers and related publications such as Congressional Research Service reports. This includes the law reviews, legal journals (such as the Stanford Technology Law Review), working papers, and reports that are only available online. In addition, LTRC provides a complimentary list of full-text content online, however, it requires manual searches or browsing.
