Federal Trade Commission's Disposal Rule
According to the Federal Trade Commission, effective June 1, 2005, attorneys must comply with the new FTC Fair and Accurate Credit Transactions Act (FACTA) Disposal Rule which governs the destruction of attorneys' client files. The rule calls for the proper disposal of information in consumer reports and records to protect against “unauthorized access to or use of the information.” Read this FTC Business Alert before you dispose of your clients' files:
