Rule 16

If you are evaluating whether the new Rule 16 applies to one of your existing cases before July 1, 2002, here are some general guidelines that may or may not apply, depending on the unique facts of your case:

1)   If the action has commenced, but no CMO has been filed in the case, then the new Rule 16 will probably apply for the duration of the case.

2)   If a CMO has already been filed, then the deadlines and discovery parameters set forth in it will apply until they have been exhausted (e.g., the end of discovery), at which point the new rules will probably apply for the remainder of that case. 

3)   If the case you are evaluating is in between the expiration of the deadlines set forth in the CMO and the filing of a Trial Management Order, then the new rules will probably apply for the remainder of that case. 

4)   If you are evaluating a case where a Trial Management Order has already been entered, then the new rules will probably not impact that case.
