CHIEF JUSTICE BENDER and JUSTICE EID would grant as to the following issues:
Whether the contractual terms “completion” or “completion of a well” are ambiguous in an oil and gas lease when the trial court, sitting as the trier of fact, determined they have differing meanings when used in oil and gas agreements.
Whether these terms are ambiguous as a matter of law when they are susceptible to differing meanings within the relevant trade or industry.
Whether Colorado’s implied duty to explore and develop every oil and gas lease is eliminated as a matter of law when the oil and gas lease has a “continuous operations clause,” and whether remand is required to consider this issue which was not addressed by the court of appeals.
