Whether the prosecution’s statements during closing argument discussing what the defendant has to “prove” with respect to his alibi defense, considered in light of the entire record, including the prosecution’s cross examination, constitutes impermissible burden shifting under People v. Santana,255 P.3d 1125 (Colo. 2011).

Whether it is fundamentally unfair and prejudicial for the trial court judge, during voir dire, to tell the jury that the defendant “obviously did something” and that “we didn’t just walk out to the bus stop” and tell the defendant that “today is your lucky day.”
Whether the prosecution impermissibly shifts the burden of proof and undermines a defendant’s right to a fair trial by an impartial jury when it argues, in opening, that the defendant “made up” a story to arresting officers, and argues, in closing, that the burden of proof no longer applies and that no affirmative defense applies in the case even when the trial court determines that the defendant is entitled to raise the affirmative defense and the prosecution must disprove it beyond a reasonable doubt.
Whether the numerous trial errors, all of which concerned the presumption of innocence and the prosecution’s burden of proof, cumulatively deprived the petitioner of his due process right to a fair trial as Judge Rothenberg concluded in her dissenting opinion.

Whether the court of appeals incorrectly interpreted the sex offender registration statute, specifically section 16-22-103(1)(b), C.R.S. 2011, to require an element-by-element comparison of a defendant’s out-of-state conviction with that of an unlawful sexual offense in Colorado.
Whether, even assuming the court of appeals properly applied the elements test to the defendant’s out-of-state conviction, the district court’s decision should have been affirmed because the defendant was still required to register as a sex offender pursuant to a separate subsection of the Sex Offender Registration Act, and was therefore, still in violation of his duty to register as a sex offender.
