1) Enforcing or invalidating class arbitration waivers (Dirk de Roos, Faegre & Benson) 

A. What is a class arbitration waiver?
B. What are the arguments in favor of them?
C. What are the arguments against them?
D. State and federal court decisions invalidating class arbitration waivers
E. State and federal court decisions upholding class arbitration waivers
F. Predicting enforceability of class arbitration waivers in the Colorado.

2) Class Arbitrations (O. Russel Murray, ADR Source)

A. What is class arbitration?
B. What special rules apply for class arbitration vs. other types of arbitration?

1. AAA rules
2. Other rules

C. Confidentiality/publicity issues
D. Who is bound by an arbitrator's decision in class arbitration?
E. Are there any avenues for appeal or collateral attack?

The cost of the luncheon is $15.00 for Litigation Section members, $20.00 for Non-Members. Vegetarian meals must be requested when making reservation. 

Call-in option will be $5, please RSVP to mailto:lunches@cobar.org, and indicate that you would like to call-in.  Instructions for the call-in will be sent out before the luncheon.
