***5TH JUDICIAL DISTRICT NEWS 05/2012**

DISSOLUTION OF MARRIAGE

  • Initial Status Conferences are held within 42 days with the FCF and are always in person.  Notice of the ISC will be served and if there is a reasonable conflict in scheduling, reschedule directly through the FCF
  • After the ISC, a review is set 3-30 days out
  • Follow up status conferences are held usually by telephone in increments of approximately 30 days
  • If it appears the case will not be settled, a Case Management Conference with a judge is scheduled either in person or by telephone as the case needs
  • Temporary Orders are discussed with the FCF with the hope of reaching a temporary agreement
  • Please read the Order Re: 121 Duty to Confer
  • Mediation is required if issues cannot be resolved by the parties and/or with the assistance of the FCF
  • Status Conferences are used to gain permission to file motions consistent with C.R.C.P. 16.2(c)(4)(B).

PROTECTION ORDERS

  • If no Domestic Relations (DR) case has been filed and the TPO is first in the county court, the county court will inquire as to whether a DR case will be filed.  If so, the court will try to set the ISC in the DR case more quickly.

POST DECREE

  • The FCF handles all of the post decree DR cases involving modifications of child support and parenting time. 
  • If there is a mediation requirement in the separation agreement, the parties will need to fulfill that requirement before the ISC or the post decree matter.

In the 8th Judicial District, all DR cases are assigned to a District Court Magistrate.  At present, that is Magistrate John Jostad in Division 2B.

Rule 16.2 (c)(4) addresses the motions that are allowed to be filed without the Court’s permission. 

Failure to meet and confer prior to the filing of any motion may result in its denial solely for that reason.

The Court expects strict adherance to this rule, with the exception of Motions for Temporary Orders and Notice to Set hearing, which may be filed at any time in the case. 

Absent Court approval, a temporary orders hearing will not be held prior to the Initial status Conference with the Family Court Facilitator.

The Family Court Facilitator will address any stipulated agreements, either permanent or temporary, and may put the stipulated agreements on the record at the Initial Status Conference.

READ THE NEW CASE MANAGEMENT ORDERS POSTED HERE!  YOUR CASE CAN BE DISMISSED IF YOU DO NOT ADHERE TO THE DEADLINES STATED IN THESE ORDERS!

Pre-Decree cases must be set within 119 days (file POSO) and Post-Decree cases must be set within 63 days (PDSO).

NOTES:

  • If you set Permanent Orders for more than half a day, set a pretrial conference at the same time.
  • Settings are not done at a particular time; e-mail or call for dates.
  • Mediation is required before Permanent Orders even if there was mediation before Temporary Orders.
  • Meaningful conferring with opposing counsel is mandatory before filing any Motion.
  • Do not call to inquire on status of motions until at least 30 days has passed.  Only call once.  File a status report if the situation changes before the court rules on your Motion.
  • The only permitted Emergency Motion is endangerment of a child.  If you file an emergency Motion, e-mail the court to alert them it has been filed.
  • The Lexis entries that indicate "Minute Order" are only staff notes.  You may obtain a copy by a call or e-mail to the clerk through the Lexis system.
  • The ISC is not a hearing.  You can file a Status Order containing any orders that were entered.  You are permitted to look at the notes, make your request via e-mail.  
  • Court Facilitator (Heather Lang): Initial Status Conferences. The Stipulated Case Management Plan filed in lieu of attendance at the ISC must be filed SEVEN DAYS BEFORE THE DATE OF THE ISC.  If it is not filed 7 days before and if it is not in conformance with the court form, the CASE MAY BE DISMISSED if no one appears at the ISC.
