A Funny Thing Happened On The Way To The First Amendment Forum: Analyzing Free Speech And The Forum Doctrine In The Modern Era

Under the “forum doctrine,” all government property belongs to the public both physically and metaphysically, but not all government property is equally suitable for expressive use. The lawful limitations on permitted expression is dependent on which forum applies. These issues tend to be easier to analyze when it comes to sidewalks, parks, and Council/Board chambers. However, they get more complicated with lobbies, government workspace, virtual platforms, and parking lots.  We'll discuss the basic foundation of the forum doctrine and how that has been applied in First Amendment cases. We'll discuss the appropriate restrictions and what the Courts have ruled is protected expression. Then, we'll have a forum doctrine discussion regarding places that are not so obvious, such as government building lobbies, social media platforms, online forums, parking lots, and rented space. We'll discuss “First Amendment auditing” and how local governments, either intentionally or not, change the legal forum through policies or practice. This will be an interactive workshop designed to educate and share practical ideas for addressing and protecting free speech in our government spaces.    
   
Presented by Nancy Rodgers
Nancy Rodgers has served as the Broomfield City and County Attorney since January 2021.  Prior to working with Broomfield, she served as the Deputy City Attorney for Aurora and was a partner in the law firm of Kissinger & Fellman, PC.  Her local government practices has primarily focused on police issues, civil litigation, employment law, contracts, legislative drafting, and CORA/COML.
