Understanding Senate Bill 21-088: The Child Sexual Abuse Accountability Act

In 2021, the Colorado Legislature passed Senate Bill 21-088, which establishes a new cause of action that may be brought against both private and public organizations for child sexual abuse perpetrated by adults affiliated with the organization's youth programming. Additionally, Senate Bill 21-088 fundamentally alters the statute of limitations for claims that may be brought by victims of child sexual abuse. This program unpacks the details of Senate Bill 21-088 through an examination of the intent behind the bill; who may be held liable under the new cause of action; changes to the statute of limitations for child sexual abuse; restrictions on the Colorado Governmental Immunity Act; recent cases brought under Senate Bill 21-088; and considerations and best practices for managing organizational risk.
