In this presentation, we will review legal, financial and enforcement trends identified from recent CMS and OIG voluntary self-disclosure protocols, including CMS’s Self-Referral Disclosure Protocol for Stark Law violations, and OIG’s Self-Disclosure Protocol for federal Anti-Kickback Statute (alone or in combination with other law) violations based on recent settlements. We will also explore the U.S. Department of Justice’s key focal areas for healthcare fraud and abuse which can help providers in weighing the value in voluntarily self-disclosing noncompliance issues against the potential for enforcement. Finally, we will talk through the key considerations in deciding whether to self-disclose or not, things to consider prior to self-disclosing, and how to proceed with a voluntary self-disclosure under a government protocol.
