TC Heartland's Effect on the Busiest Patent Venues

The Supreme Court’s decision in TC Heartland changed the widely relied-upon interpretation of the patent venue statute, sending shock waves through the patent litigation community. Following the ruling, patent litigators initially expected that the profile of patent litigation venues would fundamentally change, placing a heavier burden on the District of Delaware and reducing the case load in the Eastern District of Texas. Now, four months have passed since the TC Heartland decision. District Courts are beginning to interpret the opinion and the Federal Circuit is poised to weigh in. During this luncheon, the panel will discuss TC Heartland, and how the holdinghas been applied so far, particularly in the nation’s busiest patent venues, the Eastern District of Texas and the District of Delaware. The panel will also discuss the practical effect on those districts, and whether it has borne out the expectations of commentators.
