Employment disputes raise all sorts of issues when it comes to the attorney-client privilege, work product doctrine, and disqualification of counsel. Are the materials from an internal investigation protected? What’s the scope of that protection? Can those protections be waived? Should I even represent my client in this matter? If I do, what potential risks does my client face? This program is intended to give you some useful information when thinking, or litigating, these multi-faceted issues from the perspective of those trying to protect the information and those who may be seeking it in discovery.
 
 
Nicholas Haynes, Esq.- Nicholas Haynes is an associate in the Denver office of Lewis Brisbois and a member of the Labor & Employment Practice. He provides advice and counsel to employers regarding compliance with state and federal employment law, including wage and hour, leaves of absence, workplace investigations, performance management, and issues that arise from the time of hire to separation from employment. Mr. Haynes has experience training employers and providing presentations on new employment laws, investigations, employee relations, performance management, leaves of absence, harassment prevention, unemployment, and garnishments and withholding orders. He is licensed to practice law in California and Colorado.
 
James E. Fogg, Esq.- James is an associate at Ogborn Mihm, LLP where he practices primarily in the areas of business, trusts and estates, and legal malpractice litigation. Previously, James served as a judicial law clerk at the Colorado Court of Appeals for the Hon. James S. Casebolt. He co-authored the latest chapter on disqualification of counsel in Lawyers’ Professional Liability in Colorado: Preventing Legal Malpractice & Disciplinary Actions (4th ed.) and has guest lectured on various topics relating to litigation and trial practice. James received his law degree from the University of Denver’s Sturm College of Law and is licensed to practice in the State of Colorado.
