In the past few years, several high-profile defendants in mass tort cases, including Purdue Pharma, Johnson & Johnson, and the Boy Scouts of America, have filed for bankruptcy protection. In its last term, the Supreme Court made two important rulings that will impact the ability of defendant/debtors to structure settlements through the bankruptcy court. Join George Singer for a discussion of the Court’s decisions in Truck Insurance Exchange v. Kaiser Gypsum Company, Inc. and Harrington v. Purdue Pharma, and how those decisions will affect other mass tort bankruptcy cases
