Stuart Rossman- "Telephone Consumer Protection Act"
The Telephone Consumer Protection Act (TCPA) is an important federal consumer protection that restricts telephone solicitations and automated telephone equipment. It can play an important role in protecting debtors from aggressive and illegal debt collection techniques and other consumers, including elders, from scams. Stuart will present on the TCPA and discuss how it can be used to protect vulnerable consumers.
 
Daniel J Vedra- "What Every Plaintiff's Personal Injury and Bankruptcy Attorney Should Know About the FDCPA"
Every Personal Injury and Bankruptcy Attorney is likely familiar with debt collection notices. The Colorado and Federal FDCPA provides a private cause of action when collection communications cross the line and harass, mislead, or deceive consumers. This CLE will cover the basics of the Colorado and
Federal FDCPA for bringing claims against debt collectors, including:
- The remedies available under the FDCPA
- The basic prohibitions under the FDCPA
- How to stop debt collector harassment
- The differences between the Colorado and Federal FDCPA
 
 
Sarah McEahern- "Pursuing an Insurance Bad Faith Claim"
An overview of the obligations imposed on insurance companies under Colorado law to their insured, including a duty of good faith. The course will cover the basics of pursuing an insurance bad faith claim for unreasonable delay or denial of an insurance claim, discussing practice pointers and the recent Colorado Supreme Court decision, State Farm Mut. Auto. Ins. Co. v. Fisher, 418 P.3d 501 (Colo. 2018), which reaffirmed and expanded the rights of consumers that purchase uninsured/underinsured motorist policies.

Any lawyer whose practice is either devoted primarily to creditors’ rights or who dabbles occasionally in the collection of debts must become familiar with both the FDCPA and the Colorado FDCPA.
