A Deep Dive into the Duty to Defend
 
Tuesday, March 23 from noon to 1:00 p.m.
 
The Insurance Committee welcomes you to join us in a “deep dive” of duty to defend issues. We invite and encourage you to join our community forum meeting to share with your policyholder and insurer counsel colleagues your experiences, questions and opinions on these topics:
 
  • The Complaint Rule: why duty to defend is broader than duty to indemnify, waivers from failure to defend, right to reimbursement under Hecla, and applicability of the Pompa and AIMCO exceptions;
  • The Failure to Cooperate Defense under CRS 10-3-1118 as it applies to an insurer's duty to defend its insured;
  • Additional Insured matters: priority of additional insureds and the insurer's obligations based on policy terms, contractual requirements and the Anti-Indemnity Statute;
  • Reservations of Rights: defense afforded under the ROR and elements of a properly executed ROR, and waivers; and
  • Anticipatory Declaratory Judgment Actions.
 
Also, if there are additional duty to defend issues you would like to discuss, please let us know before the meeting so we can add them to the agenda.

Speakers:
 
Damian J. Arguello is the founder and Principal Attorney of Colorado Insurance Law Center, a private law firm representing insurance policyholders and providing insurance-related expert witness services. Damian is a former claims manager and counsels businesses, individuals, other attorneys, and insurance brokers on insurance matters. Damian is also an adjunct professor of insurance law at both the University of Denver Sturm College of Law and the University of Colorado Law School. He writes and speaks frequently on insurance and risk management matters.
 
Kristin A. Allan is the founder of Allan Law, PLLC. Ms. Allan focuses her practice on contract interpretation, insurance coverage, insurance declaratory actions and coverage litigation. She provides legal opinions, advice, and education to insurers on a variety of insurance coverage issues within personal and commercial insurance policies. She is also actively involved in several nationwide and Colorado legal associations and groups and speaks regularly in insurance coverage related issues. Ms. Allan serves as the At large Member of the Colorado Bar Association's Insurance Committee. She is also actively involved in several nationwide and Colorado legal associations and groups. Ms. Allan earned her B.A. degree from State University of New York at Geneseo and her J.D. degree from Brooklyn Law School. She is admitted to practice in Colorado
and New York.
