Program Description
 
 
After nearly fifty years of discussions and negotiations, the European Union (EU) is at last on track to implement a unitary patent system that will allow patent applicants to obtain patent protection in (almost) all EU member states via a single procedure. This system is currently expected to be fully operational on 1 June 2023, with a “sunrise” period beginning on 1 March 2023. But not all patent applicants will want to utilize the new unitary system, and many will prefer to continue under the European Patent Organization's current “validation” system, which will still be available for at least seven years. This 1.0-hour presentation will enable U.S. intellectual property attorneys to advise their clients as to the pros and cons of the new unitary system and help them determine whether and how to opt out of this intriguing (but untested) legal regime.
 
 
Speaker Bio
 
Tyler Boschert is a shareholder at Sheridan Ross P.C. in Denver. His practice focuses mainly on patent prosecution both in the United States and in foreign jurisdictions, including especially Europe. As a member of Sheridan Ross' Chemistry and Life Sciences practice groups, he works closely with foreign associates around the world to develop and maintain global patent portfolios for clients in a wide variety of fields, from food products, probiotics, and pharmaceuticals to precious metal mining, polymers, and photovoltaic materials. He also assists clients with adversarial administrative patent proceedings, such as opposition proceedings before the European Patent Office, and advises clients on all technology-related aspects of intellectual property strategy, including licensing, material transfer agreements, and invention disclosure and trade secret policies for employees. He holds a bachelor's degree in chemical engineering and economics from Northwestern University and a J.D. from the University of Colorado.
