OSHA PRIMER
This primer provides a description of the fundamentals of the Occupational Safety and Health Act (OSH Act), the Occupational Safety and Health Administration (OSHA) and the role of the Occupational Safety and Health Review Commission (Commission) in the adjudication of disputes. The session will cover the statutes and regulations involved in OSHA practice, OSHA enforcement of the regulations and standards promulgated pursuant to the OSH Act, the role of the Commission and the appellate courts, and the practice before those tribunals.
 
The panel will address developments on OSHAs enforcement programs and initiatives, including egregious cases, enforcement of novel hazards, monitoring corporate settlements, the new record keeping data initiative and potential issues arising during inspections and the severe violator program.
 
The panel will discuss legal issues which may arise during OSHA inspections and how companies are selected for inspection. Among the topics to be discussed will be walk around rights, employee and management interviews, warrants and subpoenas, multiple agency jurisdiction, post-inspection/pre-citation discovery and use of expert witnesses.
 
The panel will discuss the types of citations which OSHA may issue and the penalty maximums associated with citation classification.
 
Finally, the panel will touch on issues involving the multi-employer doctrine.
