Carl Graham will walk attendees through the following outline:
1. Jurisdiction to Divide Military retirement
2. Types of Military Retirement - High 3, final pay, redux, blended retirement and thrift savings plan
3. Military retirement calculation - retired pay subject to division, frozen benefit rule, Hunt Coverture Formula, Reserves/National Guard, Examples
4. Direct retirement payment from DFAS - 10/10 rule, order needs, sample language to divide military retirement, send to DFAS, no deadline, maximum amounts
5. Survivor benefit plan - insurance policy, maximum designated base amount, beneficiaries, premiums, premium responsibility, deemed election, deadline, failure to elect
6. VA Disability - disability ratings, sample amounts, indemnity for VA waiver, examples, other states, disability is income for maintenance and child support, temporary disability retired list, permanent disability retired list
7. Other receipts in lieu of retirement
8. Garnishment of military retirement - retiree
Carl O. Graham is the managing partner of Graham.Law, a Colorado Springs family law firm. He graduated from the University of Southampton in the United Kingdom in 1988 with a B.Sc. (Honours) degree, and received his J.D. from the UCLA School of Law in 1991. Carl was an Army JAG officer from 1992 to 2000, whereupon he entered private practice. He was chair of the El Paso County Bar Association Family Law Section, and has held leadership positions in the El Paso County Bar Association, the CBA Family Law Section, and other legal organizations. Carl has presented at over 30 CLEs sponsored by the CBA, AAML, El Paso County Bar, and other organizations. He created two online guides: the Colorado Divorce & Family Law Guide (www.colorado-family-law.com) and the Military Divorce Guide (www.military-divorce-guide.com), wrote "An Introduction to Family Law and the Military" for the Colorado Lawyer, and is author of the Military Parenting chapter of the CBA publication, Practitioner's Guide to Colorado Domestic Relations Law. Carl is listed as a Colorado Super Lawyer, named one of the Best Lawyers in America by U.S. News & World Report, and is rated Distinguished by Martindale-Hubbell.
