Estate administration can always be challenging, but estate administration for farmers and ranchers can bring an added level of drama. Estate taxes, valuations, prenuptial agreements, family values and other aspects can read like a movie or soap opera. As our clients are not fictional, and their issues are not created by Hollywood writers, there is therefore no easy way to solve problems – except for effective planning. Each transition that comes on the ranch creates an opportunity – either for success or failure of the business. When heirs move back to the farm or move away from the farm, there are challenges in planning to address. Changes in land values and asset values drastically can change an estate planner’s approach to the issues. Disability or death of a spouse, changes in farming practices, operation, and crops; as well as changes in a family structure all are opportunities for a pitfall to arise.
