RE: I have an Order for mediation in an ERISA case. OC will not agree to any mediator who is not a retired fed magistrate or retired fed judge. Am concerned this restriction is because OC believes any retired fed person will be very strict on pushing at mediation an arbitrary/capricious standard of proof an won't push for a fair settlement. Any suggestions for a good, fair, objective mediator who is a retired fed judge or magistrate?
